Judgement

MANGAJI, JCA (Delivering the Lead Judgment): By an application dated 13/2/97 the appellant herein being the judgment debtor in a judgment delivered at the Upper Area Court II, Yola, Adamawa State sought anextension of time within which to appeal and leave to so appeal against the judgment of the trial Upper Area Court. The motion for extension of time to appeal and leave to appeal was filed before the High Court of Adamawa State sitting in its appellate jurisdiction. The application reads:- “(a) An order of this Honourable Court extending the time within which to appeal (to the applicant) against the decision of Upper Area Court II Yola in suit No. UAC2Y/CV/FI/52/95 delivered on the 27th day of May, 1996.

An order of this Honourable Court deeming the proposed notice of appeal attached and marked as exhibit ‘A’ to the affidavit in support of this application as properly filed andserved.

Any other order or orders as this Honourable Court may deem fit to make in the circumstance.”
