By an amended writ and statement of claim filed on 31 January 1986 the plaintiff’s claim, as administrator of the estate of the late Mohamadu Yortuhor Anane, against the defendants jointly and severally, is for damages by virtue of the Civil Liability Act, 1963 (Act 176). The indorsement further stated that the claim which is for the benefit of the estate of the deceased and his dependants is for, inter alia, loss of dependency and loss of expectation of life arising out of the negligent driving of the second defendants’ Mercedes Benz articulated truck No. GT 2056 by the first defendant, then agent and servant or both of the second defendant, on or about 21 October 1982 on the Gambaga Scarp and which negligent driving caused the death of the deceased.
