BULKACHUWA JCA, (Delivering the Lead Ruling): The applicant/ respondent by way of a motion on notice filed on 28th November, year 2000 is seeking the following reliefs.
An order of extension of time within which the applicant may file a Notice of Cross - Appeal against the judgment of the Federal High Court Abuja in Suit No. FHC/ABJ/20196 per Senlong J. dated 5/4/98.
And for such further or other Orders as this Honourable Court may deem fit to make in the circumstances of this case.
The application is supported by an affidavit of 18 paragraphs and an annexture (exhibit DT1) which is the proposed Notice of Cross - Appeal. The respondent did not file a counter-affidavit to the application but opposed it on point of law while the applicant was moving the application.
While moving the application before this court, learned counsel for the applicant relied on the supporting affidavit and the annexed proposed Notice of Cross-Appeal.
