Judgement

AWALA, J.C.A. (Delivering the Leading Judgment): This appeal is against the decision of Dakwak, J. of the Plateau State High Court holden at Jos delivered on the 7th day of June. 2006. The ruling is sequel to an application by way of motion on notice dated 9/2/06 filed the same day by the appellant seeking basically one relief: An Order of the lower court to re-assign and/or transfer the case No. PLD/J/13C/05 The State v. (1) Saleh Uba Zakari and (2) Alhaji Shehu Dogo - from the High court sitting at Langtang to Jos High Court.

And for such further order(s) as the Honourable court may deemed fit to make in the circumstances.

The said motion is supported with a five paragraphed affidavit.

Only the 3rd and 4th paragraphs are pertinent as follows:-

"3(a) The applicant was initially arraigned before the Upper Area Court Kabong Jos, which remanded the applicant and the same later recalled the order. The Upper Area Court Kabong order of 1/12/04 is annexed hereto and marked as exhibit "A".
