EBIOWEI TOBI, J.C.A. (Delivering the Leading Judgment): This appeal is against the decision of Hon. Justice N. I. Afolabi of the Federal High Court of Nigeria, Gombe judicial division delivered on 23/07/2020 in Case No: FHC/GM/9C/2015 wherein, the Appellant was arraigned by the Economic and Financial Crimes Commission on a seven Count Charge bordering on the offences under Sections 16(6)(b), (11) and 58(5) of the Public Procurement Act 2007, Sections 1(2)(3)of the Advance Fee Fraud and other Fraud Related Offences Act, 2006 and Sections 465, 468 and 471 of the Criminal Code Act LFN, 2004. The Appellant pleaded not guilty to all the Counts of the said Charge and the matter was set down for trial. At the trial, the Respondent called 4 witnesses and tendered Exhibits. The Appellant also testified for himself as the sole witness and tendered Exhibits.
