YARGATA BYENCHIT NIMPAR, JCA (Delivering the Leading Judgment): This appeal is against the judgment of the Federal High Court sitting in Lagos and delivered on the 12th April, 2006 by HON. JUSTICE A.R. MOHAMMED wherein the claim of the Appellant was partially granted, dissatisfied with the decision not to award damages, the Appellant filed a Notice of Appeal dated 1st May, 2006 and filed on the 1st June, 2006 setting out 9 grounds of appeal.

Brief background facts are that the Appellant as applicant in an application to enforce his fundamental rights filed before the trial Court and upon consideration, the Court below partially allowed the application. Dissatisfied with the refusal to award damages for unlawful detention, the Appellant filed this appeal. The claim of the Appellant before the Court below states thus:
