AKAAHS, J.C.A. (Delivering the Leading Judgment): The petitioner/appellant, Barrister Cyprian Chukwu, was a candidate for the chairmanship election held for Obio/Akpor Local Government Area of Rivers State on 5/12/98 and 12/12/98. He stood for the election under the platform of the Alliance for Democracy (AD). The 1st, 2nd and 3rd respondents belonged to the Peoples Democratic Party (PDP), the 4th respondent. The 4th respondent did not quite decide between the 1st and 3rd respondents who was to be its candidate for the December 5th 1998 chairmanship election for Obio/Akpor Local Government Area and so it wrote a number of letters to the Resident Electoral Commissioner in-charge of the Independent National Electoral Commission, Rivers State submitting the name of either the 1st respondent or 3rd respondent as its candidate for the chairmanship election.
